(FixThisNation.com) – The Wall Street Journal’s editorial board on Monday argued against the possibility that former President Donald Trump should be blocked from the 2024 presidential ballot because of the 14th Amendment.
In their piece, they pointed out that the recent indictment of the former President has helped boost his position in the Republican primary polls. They further pointed out that the idea of having him removed through the 14th Amendment was the worst idea that his opponents have come up with since their suggestion in 2017 that he should be disqualified from the race because of the 25th Amendment. As they pointed out his opponents were now hoping that they would be able to use Section 3 of the 14th Amendment of the Constitution in order to get him disqualified completely.
The argument that the 14th Amendment which blocks anyone who had previously held office and had “engaged in insurrection” from holding office again, has been gaining traction with many Democrats, GOP presidential hopefuls, and legal scholars. In their argument, they have claimed that Trump’s role in the Jan. 6, 2021, Capitol attack disqualified him from serving as the U.S. president because of the 14th Amendment.
However, the editorial board opposes this claim that Trump’s alleged actions amounted to an insurrection. They further noted that thus far the former President has not been charged with insurrection and that if this was a case that could have been proven in court then the Department of Justice’s special counsel Jack Smith would have charged him.
